Applied Biosystems Obtains Injunctions In Germany Against Bio-Rad And MJ Research
Companies enjoined from selling certain thermal cyclers; similar injunction previously issued against Bio-Rad in Japan
Foster City. Applied Biosystems (NYSE:ABI), an Applera Corporation business, today announced that the German District Court in Düsseldorf, Germany, has issued injunctions against Bio-Rad Laboratories, Inc. , MJ Research, Inc., and Biozym, MJ Research's distributor in Germany. The injunctions proscribe the manufacture and sale of real-time thermal cyclers capable of performing real-time PCR (polymerase chain reaction) methods. The Court found that the defendants infringe the German national patent corresponding to European Patent No. 872562, issued to Applera in September 2002.
In April 2003, a similar injunction was obtained against Bio-Rad in Japan based on a corresponding Japanese patent.
"The foundational real-time PCR instrument patents issued to Applera in Europe and Japan are valuable parts of our intellectual property estate and reflect our continuing investment in innovation in this important area of our technology," said Michael W.
